This website is operated by Icarus Precision. Throughout the site, the terms "we," "us," and "our" refer to Icarus Precision. Icarus Precision offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all the terms, conditions, policies, and notices stated here in “Terms and Conditions (T&Cs)”.

By visiting our site and/or purchasing something from us, you engage in our "T&Cs" and agree to be bound by the following terms and conditions, including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These T&Cs apply to all users of the site, including without limitation, users who are browsers, customers, vendors, merchants, and/or content contributors.

Please read these T&Cs carefully before accessing or using our website. The following T&Cs apply to all of our websites, including any websites owned, operated or sponsored by any of our subsidiaries or affiliates. “Content” refers to any materials, documents, images, graphics, logos, design, audio, video, and any other information provided from or on our websites. By accessing or using any part of the site, you agree to be bound by the stated T&Cs. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these T&Cs are considered an offer, acceptance is expressly limited to these T&Cs. 

Any new features or tools which are added to the current store shall also be subject to the following T&Cs. You can review the most current version of the T&Cs at any time on this page. We reserve the right to update, change, or replace any part of these T&Cs at any time without express notice. It is your responsibility to check this page periodically for changes or updates. Your continued use of or access to our website following the posting of any changes constitutes acceptance of the T&Cs in its entirety. 

These T&Cs are the only terms which govern the sale of products and/or services by Icarus Precision, LLC to purchasers of Icarus products in the United States. By placing your order for Icarus products, you accept and are bound by these Terms. If you have placed an order but do not wish to be subject to these Terms, you must promptly cancel your order before it becomes non-cancelable, or return your purchase in accordance with our Return Policy.

Certification

To access our website content or to purchase Icarus products, you must agree to the following:

• You have not been convicted in any court of a crime punishable by imprisonment for a term exceeding 1 year;

• You are not a fugitive from justice;

• You are not an unlawful user of or addicted to any controlled substance;

• You have not been adjudicated as a mental defective or been committed to a mental institution;

• You are not an alien illegally or unlawfully in the United States or an alien admitted to the United States under a nonimmigrant visa;

• You have not been discharged from the Armed Forces under dishonorable conditions;

• You have not renounced your United States citizenship;

• You are not subject to a court order that restrains you from harassing, stalking, or threatening an intimate partner or child, issued after a hearing ending in a finding that you represent a credible threat to the intimate partner or child OR explicitly prohibits the use, attempted use, or threatened use of force against the partner; and

• You have not been convicted of a misdemeanor crime of domestic violence.

Payment Terms

Terms of payment are within our sole discretion unless otherwise agreed to in writing. Payment must be received prior to acceptance of an order. Payment for any products will be made exclusively by credit card, wire transfer, or other pre-arranged payment method unless credit terms have been agreed to in writing by a member of our team. Invoices are due and payable within 30 days or the indicated time period noted on the applicable invoice, measured from the date of the invoice, after which late fees will apply. We may invoice parts of an order separately. Your order is subject to cancellation, at our sole discretion. Your remedy in case of such cancellation is limited to funds actually paid to us for such order. We are not responsible for pricing, typographical or other errors in any offer, and reserve the right to cancel any orders arising from such errors. 

Shipping Policies

Shipping rates are automatically generated by our site based on, amongst other factors, the purchased products and their destination. Due to constant pricing changes from shipping carriers, your shipping total is dependent on what is ordered, the package size, the delivery destination & other factors. 

Typically, orders are compiled on a weekly basis for shipment on Tuesdays. Orders received between Monday at 12:00am PST through Sunday at 11:59pm PST will ship the following Tuesday unless the website indicates lead times, back ordered, out of stock, or discontinued. We work hard to make sure our website reflects our inventory accurately, but due to supply chain issues, logistics issues, seasonal variation, and other factors outside of our control, actual inventory and shipping times may differ from what the website shows. Orders are shipped once they can be fulfilled in entirety. We do NOT ship partial orders. Orders containing products purchased on a lead time basis will NOT ship until they can be fulfilled in its entirety.

Shipping, handling, and tax are additional fees that are the customer’s responsibility, unless otherwise expressly indicated at the time of sale. Title to purchased products passes from us to the customer upon handing over to the carrier. Loss or damage that occurs during shipping by a carrier selected by you is your responsibility. Loss or damage that occurs during shipping by a carrier selected by us is our responsibility. You must notify us within 14 days of delivery if you believe any part of your purchase is missing, incorrect or damaged. Shipping and delivery dates are estimates only.

Expedited shipping may be requested, but is not guaranteed, and is at the sole expense of the customer. At this time, we do not offer international shipments; please inquire with us directly for information regarding other vendors of our products who may have this service available.

We do our very best to get you your purchases on time and as promised. As noted above, factors outside of our control may interfere with product availability and expected shipping timelines. For this reason, we cannot guarantee exact arrival times. Thank you for your understanding. 

Return Policies 

Eligibility: Any product intended for return must have a Return Merchandise Authorization (“RMA”) form submitted within 14 days of delivery on said product accompanied by a valid order receipt or confirmation. The product intended for return must be in “like new” condition - it must be in unused, unworn, undamaged, and unaltered condition, with all original packaging and accompanying materials (if applicable) intact. 

**NOTE: NON-RETURNABLE Exceptions** 

We do not accept any returns related to customer damage or normal wear and tear, as determined in our judgment. We also do not accept returns on items with custom Cerakote coatings or on any of our limited edition artisan products (i.e. laser engraved or custom products). Additionally, all sales are FINAL on items with custom coatings, engraved or custom products, any limited edition artisan products, closeout or clearance products, complete firearms, or special orders. Our ability to replace products under warranty may be limited by product availability. 

Return Merchandise Authorization (“RMA”): Any intended return on purchased products must be requested and submitted within 14 days of shipping delivery. Submitting a RMA request does not guarantee that we will accept your return, you must wait for approval or consent from our team after submitting the request form. Any return on Icarus products must have prior consent and approval in the form of a RMA approval or email confirmation from our team. Our team will conduct the necessary evaluations on the product(s) to verify it was purchased on our website, it has been less than 14 days from the date of receipt, and that the product intended for return is in “like new” condition. If the product is deemed eligible for return, the purchase price will be refunded, less any applicable restocking fees. Products outside of the 14-day return request window or in any other condition other than “like new” will be evaluated on a case-by-base basis and solely at our discretion.

Restocking Fee: All authorized returns will incur a 25% restocking fee. This fee covers the credit card processing fee incurred at the time of purchase and shipping, as well as our team’s time taken to resolve the issue and inspect the returned item(s). No payments other than the purchase price of the returned merchandise will be refunded,. Any payment processing fees, shipping fees, or taxes (except where required by law) will not be refunded. 

Proof of Purchase: Any return request must be accompanied by a valid receipt from our website or other acceptable proof of purchase. The name on the receipt must match the name listed on the RMA request.

Return Shipping Costs: If your authorized return is due to a material or manufacturing defect or our fulfillment error, we will issue a pre-paid return label to cover the cost of return shipping. If you are returning your product for any other reason, or under any other circumstance, you are responsible for all the return shipping fees. Regardless of the reason for the return, any risk of loss only passes back to us upon actual receipt of the returned product(s).

Missing or Damaged Items: If something in your order is missing or if items have been damaged during shipping, please contact Support@IcarusPrecision.com within 14 days of delivery. (Due to the high influx of emails we get, please allow up to 2 business days to get back to you)

Cancellation Policies

Icarus Precision strives to make your shopping experience as easy and smooth as possible. It is your responsibility to properly review the items in your cart prior to completing your purchase as the payment transaction processes immediately after submission at checkout. For any order or “pre-order”, please be sure the item(s) are correct prior to completing payment and checking out. After submitting your payment and checking out, it is extremely challenging for our team to track down any order, therefore, we cannot edit or combine orders once submitted. 

Cancellation Fees: Orders can potentially be cancelled prior to shipment at our sole discretion, but all cancellations will be charged a minimum flat $40.00 cancellation fee, and orders exceeding $800.00 will be charged a 5% fee to cover the non-refundable payment processing fee incurred at the time of purchase, regardless of the reason for cancellation or the purchase amount. 

If you make an order in error, please notify Icarus Precision via email as soon as possible at Support@IcarusPrecision.com so the order can be flagged for cancellation prior to shipment. Once your order has shipped, it can no longer be cancelled, and the regular return policy and restocking fees (as stated above) will apply. 

Warranty Policies

Compliance with Laws

You agree that you will comply with all Federal, state, and local laws, rules and regulations pertaining to products and services purchased from us. The goods and services purchased from us, including but not limited to any related drawings, samples, or technical manuals, may be restricted under the Arms Export Control Act, International Traffic in Arms Regulations, Export Administration Act, and/or Export Administration Regulations. In addition, assembly of or with our products, or placing other accessories onto our products, and/or the transport or resale of any of the above may violate applicable laws, rules or regulations and are done at your sole risk. You expressly assume all responsibility and all liability for your conduct and compliance with all laws, rules and regulations, and we expressly disclaim any responsibility or liability therefor.

Notice Required (Civil Code 3273.51(e)(1)–(2))

1. Prior to completing the sale or delivery in California or to a California resident of a firearm accessory or a firearm manufacturing machine, as those terms are defined in Section 3273.50, or of a firearm barrel unattached to a firearm, a firearm industry member shall comply with all of the following requirements:

1. The firearm industry member shall provide a prospective purchaser with a clear and conspicuous notice of the information provided in paragraph (2).

2. The firearm industry member shall receive an acknowledgment from the prospective purchaser attesting that the prospective purchaser received and understands the notice provided in paragraph (2).

2. The notice described in paragraph (1) shall clearly notify the prospective purchaser that it is generally a crime in California to engage in any of the following conduct without a valid license to manufacture firearms:

1. Manufacturing more than three firearms per calendar year in California.

2. Manufacturing a firearm using a three-dimensional printer or CNC milling machine.

3. Manufacturing a firearm for the purpose of selling or transferring ownership of that firearm to another individual who is not licensed to manufacture firearms.

4. Manufacturing a firearm for the purpose of selling, loaning, or transferring that firearm, with the intent to complete the sale, loan, or transfer without a required background check initiated by a licensed firearms dealer.

5. Allowing, facilitating, aiding, or abetting the manufacture of a firearm by a person who is legally prohibited from possessing firearms.

6. Manufacturing, or causing the manufacture of, assault weapons, machineguns, undetectable firearms, unserialized firearms, unsafe handguns that are not on the Department of Justice roster of handguns certified for sale in California, or other generally prohibited weapons.

The fact that we provide a link to a third-party website does not mean that we endorse, authorize or sponsor that website, nor does it mean that we are affiliated with the third-party website’s owners or sponsors.

Nothing on this website should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any of our trademarks without our written permission. Indemnification

You agree to indemnify, defend and hold harmless Icarus Precision, LLC, its officers, directors, employees, agents, licensors, suppliers and third party information providers from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these Terms by you.

Third Parties May Have Rights Under This Agreement

Some of the provisions of this Agreement are for the benefit of Icarus Precision, LLC and its officers, directors, employees, agents, licensors, and suppliers. Each of these individuals or entities shall have the right to assert and enforce those provisions directly against you on its own behalf.

No Waiver

Our failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement.

Limitation of Liability

DISCHARGING FIREARMS IS AN INHERENTLY DANGEROUS ACTIVITY. YOU ACKNOWLEDGE THAT YOU UNDERSTAND THAT THERE ARE VARIOUS RISKS INVOLVED THE USE OF FIREARMS, INCLUDING BUT NOT LIMITED TO INJURIES OR DEATH CAUSED BY PERSONAL NEGLIGENT OR INTENTIONAL ACTS, THE INTENTIONAL OR NEGLIGENT ACTS OF OTHER PERSONS, FAULTY EQUIPMENT, LIGHTING CONDITIONS, WEATHER, EXCESSIVE NOISE, OR DISTANCE TO MEDICAL CARE FACILITIES. YOU AGREE THAT, PRIOR TO PARTICIPATING IN THESE ACTIVITIES, YOU WILL INSPECT PREMISES AND EQUIPMENT.
